Terms and Conditions for Services Provided by PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA, located at ul. Krakowska 39, 05-090 Raszyn, NIP: 5342619047
I. GENERAL PROVISIONS
A. The condition for using the services of PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA is familiarizing oneself with and adhering to the Terms and Conditions presented below.
1.These Terms and Conditions are based on the following legal provisions:
a) the Civil Code Act of April 23, 1964 (Journal of Laws 2019, item 1145, as amended),
b) the Consumer Rights Act of May 30, 2014 (Journal of Laws 2019, item 134, as amended),
c) the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws 2019, item 123, as amended),
d) Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

B. PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA assumes that each CUSTOMER, in their own interest, provides all information correctly and truthfully; therefore, the CUSTOMER is solely responsible for any consequences resulting from incorrect, incomplete, or false completion of SYSTEM forms (providing data necessary for the proper execution of the ordered GIFT).
C. For VOUCHERS whose use may depend on the health condition, general physical or mental fitness, or age of the GIFT RECIPIENT, PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA assumes that each CUSTOMER has ensured that the GIFT RECIPIENT is able to use the VOUCHER.
II. DEFINITIONS OF TERMS USED IN THESE TERMS AND CONDITIONS
A. The terms used in these Terms and Conditions mean:
1.PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA – located at ul. Krakowska 39, 05-090 Raszyn, NIP: 5342619047.
2. SERVICE – the online store at www.palacrozalin.pl/vouchery.
3. VOUCHER – a product or service offered in the online store. It is a document confirming the conclusion of a contract and entitling its holder (GIFT RECIPIENT) to choose a service available at Pałac Rozalin. If a more expensive service is chosen, the difference must be paid. It is a delivery method involving the delivery of any PRODUCT via email to the CUSTOMER’s specified email address immediately after placing the order.
4. CUSTOMER – a person who orders a VOUCHER from Pałac Rozalin on behalf of the GIFT RECIPIENT.
5. GIFT RECIPIENT – a person who, after making a RESERVATION and presenting the PRODUCT, is entitled to REDEEM the VOUCHER as defined in these Terms and Conditions.
6. VALIDITY PERIOD – refers to the VOUCHER and means the time within which the VOUCHER must be redeemed. After this period, the VOUCHER cannot be redeemed. The VALIDITY PERIOD is 1 year from the date of placing the order through the SERVICE.
7. RESERVATION – the GIFT RECIPIENT’s notification of the preferred date for REDEEMING the VOUCHER via email or phone.
8. REDEMPTION OF THE VOUCHER – the performance of the service ordered by the CUSTOMER for the GIFT RECIPIENT. REDEMPTION OF THE VOUCHER is only possible within the VALIDITY PERIOD and if the VOUCHER is paid.
9. SYSTEM – an element of the SERVICE that, among other things, enables the contract conclusion process in accordance with the provisions of these Terms and Conditions and allows for making and confirming reservations.
10. ORDER NUMBER – a sequence of digits identifying each separate order.
11. ORDER PROCESSING TIME – the time within which Pałac Rozalin will complete the order and hand it over to the carrier delivering the chosen delivery method.
12. TRADITIONAL BANK TRANSFER – payment made by the CUSTOMER through an online bank account, at a bank branch, or at a post office.
13. ELECTRONIC TRANSFER – a fast payment made by the CUSTOMER from an online bank account via online payment systems, in accordance with the service providers’ terms.
14. ORDER CONFIRMATION – confirmation generated after the CUSTOMER places an order through the SYSTEM, containing a unique order number, the exact commercial names of the ordered PRODUCTS along with their quantity, the total order value, the chosen payment method, and information about the delivery method and other administrative costs related to the order. The ORDER CONFIRMATION is sent to the CUSTOMER at the email address provided.
III. CONCLUSION OF THE CONTRACT AND PAYMENT TERMS
A. Ordering and Purchasing the PRODUCT through the SYSTEM
1. Ordering and purchasing the PRODUCT through the SYSTEM (independently on the website) is done by following the procedures provided by the SYSTEM, i.e.:
a) selecting the VOUCHER the CUSTOMER is interested in by clicking the “add to cart” button,
b) selecting the delivery method and the method of prepayment for the VOUCHER,
c) providing the necessary data (depending on the chosen delivery method, the following data may be required: email address, first name, last name, phone number, delivery address),
d) providing additional information as prompted in the cart,
e) finalizing the order and accepting the Terms and Conditions by clicking the “Buy and Pay” button,
f) after completion, the CUSTOMER receives an ORDER CONFIRMATION via email.
2. The contract is concluded when the user clicks the “Buy and Pay” button. This is equivalent to familiarizing oneself with and accepting the terms of these Terms and Conditions, which is considered a commitment to pay the full prepayment. From this moment, it is assumed that the CUSTOMER has entered into a contract with Pałac Rozalin.
C. Prepayment Terms and VOUCHER Activation
1.The condition for activating the VOUCHER is the prepayment of the order amount. For VOUCHERS paid by traditional bank transfer, the PRODUCT remains inactive until the prepayment is credited by the Bank and marked in the SYSTEM.
2.For VOUCHERS, after purchase, the CUSTOMER can only obtain an accounting note or a non-fiscal receipt (a document confirming the payment of a specified amount), but this document is not a VAT invoice or a fiscal receipt.
3.In all cases, the prepayment is the only obligation of the CUSTOMER.
4.Under no circumstances can VOUCHERS be exchanged for money; they only entitle the holder to redeem services, subject to distance sales regulations.
5.Prepayment can be made in the following ways:
a) by bank transfer to the account: …….
b) by credit or debit card,
c) using any other partner payment systems accepted by the SYSTEM.
6.If cash on delivery is chosen, an additional fee is added in accordance with the Delivery and Administrative Fees Price List available in Appendix 2 to the Terms and Conditions (changes to the Appendix do not constitute changes to the Terms and Conditions).
7.Prepayment is considered made at the time of:
a) its receipt into the account of PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA,
b) its receipt into the accounts of partner payment systems accepted by the SYSTEM.
D. Delivery Methods and Costs
1.The VOUCHER is delivered to the CUSTOMER according to their choice in the following manner:
a) via email as an ePRODUCT to the CUSTOMER’s specified email address immediately after placing the order.
E. RESERVATION and REDEMPTION Terms
1.The GIFT RECIPIENT can redeem the VOUCHER within the VALIDITY PERIOD. To redeem the VOUCHER, the GIFT RECIPIENT must make a RESERVATION before the RESERVATION DEADLINE.
2.To change the REDEMPTION date, the GIFT RECIPIENT must contact Pałac Rozalin.
3.Failure to redeem the VOUCHER within the VALIDITY PERIOD, as well as failure to make a RESERVATION before the RESERVATION DEADLINE, results in the expiration of all rights under the contract, particularly the inability to redeem the VOUCHER by the GIFT RECIPIENT, and no claims, including claims for a refund of the prepayment, are available to the GIFT RECIPIENT or the CUSTOMER.
4.The condition for redeeming the VOUCHER is presenting the VOUCHER containing the ORDER NUMBER.
5.Failure of the GIFT RECIPIENT to appear at the redemption location or being more than 15 minutes late for the scheduled time results in the complete loss of the right to redeem the VOUCHER, regardless of the reasons, including delays or no-shows due to unforeseen circumstances.
F. Exchange Terms
1.Within the VALIDITY PERIOD, the GIFT RECIPIENT may exchange the received PRODUCT for another PRODUCT(s).
2.Such an exchange can be made for:
a) a PRODUCT of a higher purchase price, after making the appropriate additional payment,
b) a PRODUCT of the same purchase price as the received PRODUCT, without any additional fees,
c) a PRODUCT of a lower purchase price than the received PRODUCT, but in this case, the GIFT RECIPIENT is not entitled to a refund of the difference.
3.The exchange can be made in the following manner:
a) via COP, in electronic correspondence.
4.The PRODUCT or PRODUCTS received as a result of the exchange will have the same VALIDITY PERIOD as the exchanged PRODUCT.
5.PRODUCTS won in contests organized by Pałac Rozalin are not eligible for exchange.
6.PRODUCTS cannot be exchanged for a GIFT CARD.
7.In the case of exchanging a COUPON, the nominal value of the COUPON is the exchange value, regardless of the purchase price of the COUPON.
8.It is possible to use multiple PRODUCTS simultaneously during one exchange. In such a case, all PRODUCTS received as a result of the exchange will have the VALIDITY PERIOD of the earliest purchased PRODUCT among those exchanged.
9.In some cases, for security reasons, exchanges can only be made by contacting COP. In handling such cases, Pałac Rozalin has the right to request additional documents from the CUSTOMER or GIFT RECIPIENT confirming, among other things, ownership of the PRODUCT, including proof of purchase, card transaction confirmations, or additional declarations.
G. Loss or Damage of the VOUCHER
1.In the event of loss or damage to the VOUCHER, it is possible to issue a duplicate VOUCHER.
2.The condition for issuing a duplicate is a written request from the CUSTOMER sent to [email protected], containing proof of purchase or order confirmation and proof of payment.
3.Issuing a duplicate PRODUCT is not possible if the VALIDITY PERIOD has expired or the VOUCHER has been redeemed or reserved.
H. PRODUCT Prices.
1.The prices of VOUCHERS at Pałac Rozalin:
a) are given in Polish złoty,
b) are gross prices,
c) do not include potential customs fees,
d) do not include potential delivery costs and additional fees.
2.The price listed for each VOUCHER is binding at the time the CUSTOMER places the order.
IV.CUSTOMER’S RIGHT TO WITHDRAW FROM THE CONTRACT AND HANDLING OF COMPLAINTS
A. Withdrawal from the Contract
1.Distance Purchases:
a) Within 14 days of receiving the VOUCHER, if it has not yet been redeemed or reserved, the CUSTOMER may withdraw from the contract and cancel the VOUCHER without giving a reason by notifying PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA in writing at the company’s address, via email at [email protected], or in person, provided that proof of purchase issued for the prepayment is submitted. By choosing to reserve or redeem the VOUCHER, the CUSTOMER agrees to forfeit the right to withdraw from the contract before the expiration of the 14-day period described above.
b) Pałac Rozalin undertakes to process any written request to withdraw from the contract within 14 days of receipt and to refund the CUSTOMER all payments made, including delivery costs equivalent to the cheapest delivery option.
c) All refunds are processed electronically. The same payment method used by the CUSTOMER will be used for the refund, unless the CUSTOMER agrees to a different method.
2.A declaration of intent resulting in the CUSTOMER’s withdrawal from the contract is also considered to be the failure to make any payment to Pałac Rozalin’s bank account within 14 working days of placing the order or making a payment to the bank account in an amount lower than specified.
B. Handling of Complaints
1.The CUSTOMER has the right to file a complaint by notifying Pałac Rozalin in writing at the company’s address or via email at [email protected]. In the case of a complaint regarding non-performance or improper performance of the VOUCHER, the CUSTOMER or the GIFT RECIPIENT must notify within no later than 7 days from the date of VOUCHER redemption or the scheduled redemption date. The complaint letter should include: the BUYER’S or GIFT RECIPIENT’S details, ORDER NUMBER, and a description of the situation.
2.Pałac Rozalin will strive to resolve each written complaint within 14 days of receipt, acting in the best interest of the CUSTOMER or GIFT RECIPIENT.
3.In the event of non-redemption of the GIFT due to the fault of Pałac Rozalin, exceeding 14 days from the date agreed upon by the GIFT RECIPIENT as the redemption date and confirmed via email by the SUBCONTRACTOR or COP, Pałac Rozalin undertakes to pay the CUSTOMER twice the amount of the prepayment received.
4.In the event of a breach of the PRICE GUARANTEE, the CUSTOMER is entitled to a refund of the prepayment amount and free redemption of the GIFT. The CUSTOMER must report the discrepancy within a maximum of 14 days from the date of purchasing the GIFT.
5.All refunds resulting from complaints are made exclusively by bank transfer to the CUSTOMER’s account.
6.Any loss or damage to shipments, particularly postal, courier, or delivery to parcel lockers, is the responsibility of the delivery companies. In the event of damaged shipment, a damage report signed by the delivery company’s employee must be completed before accepting the shipment, or the damaged shipment must be refused, and COP must be informed.
VII. PERSONAL DATA PROTECTION AND ADMINISTRATION
A. The administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, in relation to the personal data of Users who are natural persons, is PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA.
B. The personal data of the CUSTOMER and GIFT RECIPIENT are processed by PAŁAC ROZALIN A.K. MOLGO SPÓŁKA JAWNA in accordance with applicable laws and the privacy policy contained in Appendix 1 to the Terms and Conditions..
VIII. FINAL PROVISIONS
A. Pałac Rozalin is not responsible if an unauthorized person gains possession of the VOUCHER, leading to its use. In such a case, the VOUCHER is considered redeemed by the GIFT RECIPIENT.
B. These Terms and Conditions form an integral part of the concluded contract.
